Is it legal for malls to charge for the use of toilet facilities?

CapeTalk’s Kieno Kammies received calls from listeners asking about malls which charges a fee for people who want to use their toilet facilities.

There were mixed reactions on the topic with some listeners saying the fee goes into keeping the toilets clean and some who thought toilets are a necessity and should be freely accessed.

Julian Scher, Director of Strauss Scher Attorneys says the decision lies with the owner of the property.

If the toilets are situated within a private property, the owner of the property can do as he wishes. They can even lease the toilets to a third party tenant.
