'There is no basis to remove the President' insists ANC Whip Jackson Mthembu

The ANC (African National Congress) insists that there is no legal basis to remove President Jacob Zuma from his position based on last week's Constitutional Court judgement.

Last week, the Constititional Court ruled that the Public Protector's findings are binding and that President Jacob Zuma failed to uphold, respect and protect The Constitution.

702/Cape Talk's Redi Tlhabi spoke to ANC Chief Whip, Jackson Mthembu, regarding their position on the issue.

The Constitution Section 89 says the president can only be removed on the grounds of serious violation of The Constitution or the law, serious misconduct, inability to hold office or unfitness to hold office.

If indeed the court in any way was of the view that the President has breached this Section 89 of The Constitution, it would have cited Section 89.

The court would have directed Parliament to hold an Inquiry to find out whether the president is fit to hold office.

Despite the damning ruling on Zuma and the National Assembly, the ANC has held its' ground that the president has not breached the Section 89 of The Constitution, which would require that he be removed.

With the country being in the spotlight, various ANC veterans, opposition parties and members of civil society have publicly called for Zuma to step down.

Lawyers have given us this advice and in our view this advice is sound, there is no basis to remove the president.

The court recognises that the president could have acted on the basis of unsound advice or he could have been influenced by judgement of the lower court.

That clarity has also been reaffirmed by the Constitutional Court and we are all grateful that there's this clarity.
