Hani's political status should not affect Waluś parole appeal, says law expert

The Department of Justice will today hear if it will be granted leave to appeal a High Court judgement releasing, Chris Hani's killer, Janusz Waluś on parole.

Walus was convicted after shooting the late South African Communist Party (SACP) leader at his home in Boksburg in 1993.

Criminal law expert Johan Greese says the case should not be affected by the fact that the victim was a prominent political figure.

Should there be a distinction between the murder of a political figure and that of anyone else on the street? No. To my mind it does not affect the issue at all - murder is murder in all circumstances.

Johan Greese, Criminal law expert

He says the Waluś case should not be given any preferential treatment from general parole procedures.

If the Justice Department loses the appeal it can take the matter to the Supreme Court of Appeal, which Greese says would be an exercise in futility.
