Jiba suspension dismissed, DA to appeal

The Western Cape High Court has dismissed the Democratic Alliance (DA's) application to have Deputy National Director of Public Prosecutions Nomgcobo Jiba suspended, pending an inquiry into her fitness to hold office.

Jiba has previously been criticised by the Supreme Court of Appeal in cases relating to the "spy tapes" saga, and former crime intelligence boss Richard Mdluli.

The opposition party argued that President Jacob Zuma acted irrationally when he decided not to suspend her.

According to EWN's Rahima Essop, the judge says that Jiba's case demanded that Zuma take a balanced view on the matter.

He says that the President must first satisfy himself that the circumstances justified such a step, and a cautious approach was warranted.

Essop says the DA will read the judgment and its lawyers will prepare an application for leave to appeal.
