Is the Supreme Court of Appeal the next route for the State in Pistorius matter?

Judge Thokozile Masipa rejected an application by the State to appeal against Oscar Pistorius’ 6-year murder sentence. EWN reporter Gia Nicolaides joins The Midday Report's Stephen Grootes on the line.

She says the judge considered the arguments, but does not believe another court would come to a different conclusion. She says prosecutor Gerrie Nel argued the court misdirected itself when it was looking at the judgments. Nel also felt Judge Masipa was too sympathetic towards Oscar Pistorius's personal circumstances.

Nel argues 6 years in prison is far too lenient, bearing in mind the minimum sentence for murder is 15 years.

Advocate Barry Roux disagreed, saying Oscar has been punished over and over again and if one tallies up the time spent in jail already and under house arrest it comes to an effective 8 years.

After a couple of hours deliberation, Judge Masipa returned and dismissed the application with costs.

Nicolaides says the prosecution does have the option to petition the Supreme Court of Appeal in Bloemfontein, to try and get a different outcome.

However Nel was not prepared to speak to the media at this stage about their plans.
