New property owners no longer liable for previous owner's debt

The Pretoria High Court has declared the Section of Local Government Municipal Systems Act constitutionally invalid.

This ruling which was made yesterday changes the Supreme Court of Appeal's ruling that new property owners can be held liable for historic debts that dates back 30 years.

Metro editor and The Star senior journalist, Anna Cox, says the law was inconvenient for new property owners.

Basically before if you bought a property and you have clearance and you thought everything was fine, you move in and ask for your services to be connected and they sorry no, there is historical debt attached, we can't connect your services.

The lawyers should be going to previous owners saying before you sell you must pay off everything.
