ConCourt surrogacy ruling dashes hopes for infertile women - lawyer

The Constitutional Court on Tuesday made a ruling that at least one parent must donate sperm or eggs for a surrogacy agreement to be legal in South Africa.

Robynne Friedman, Attorney at Robynne Friedman Attorneys says her client tried all avenues to conceive but failed.

She says the ruling doesn't leave much option for single mothers who would like to have biological children because adoption is extremely difficult.

The ruling maintains that there must be a genetic link between the baby and at least one of the people commissioning the surrogate pregnancy.

The argument used by the Constitutional Court judges was that if you are single you can always find a partner to co-parent with. That flies in the face of the person's own constitutional right to chose a partner, freedom to be in a gay relationship and freedom to be in heterosexual relationship...
