Eskom has legal obligation to recover its debt - High Court Judge

High Court Judge Hans Fabricius says arguments made by AfriForum to prevent Eskom from cutting power supply to indebted municipalities are 'an appeal to emotion'.

Fabricius says it’s not correct for Afriforum to claim that Eskom decided, out of the blue over Christmas, to disconnect the power supply to municipalities with outstanding electricity bills.

AfriForum argues that it's unconstitutional for Eskom to disconnect the power supply, as this will affect law abiding citizens who have been paying their accounts to the municipalities.

Eskom intends to cut the supply in order to recover billions of rands in debt from eight non-paying municipalities.

The debt stretches back as far as 2011.

The ruling will be made tomorrow.
