Health Dept request for medical aid members details may breach privacy - lawyer

The Health Department asked medical aid schemes to submit names and addresses of their members for the department to keep on its database.

Director at Werksmans Attorneys, Neil Kirby, says it is unclear what the Department of Health will do with the information it has received from medical aid schemes.

Kirby says there are aspects of the Medical Aid Schemes Act which require the Council of Medical Aid Schemes to advise the minister on certain aspects concerning medical schemes.

That Act contains a number of provisos and exceptions into how information is passed and to whom and by whom.

He says normally information that pertains to one's health status is protected.

Whether that details awarding information...to the Department of Health is going to be part of the debate.
