Policy on undocumented children is outdated

Recently Eastleigh Primary School in the east of Johannesburg threatened to refuse children of immigrants access to education and get them arrested if their papers are not in order.

Attorney at the Centre for Child Law, Karabo Ozah, says there are conditions that allow for children to be registered in schools when they do not have birth certificates or required documents if they are the child of an immigrant.

Ozah says the policy requires South African children to register and get their certificate within a period of three months.

She explains that immigrants should show that they are in the process of regularising their stay.

The assumption that most of these children are foreigners is not true. These are people whose parents and even grandparents never got IDs, and then the next generation doesn't get IDs, and the next doesn't get certificates.

The problem with the policy is that it still refers to the Aliens Control Act, which was repealed by Immigration Act, so it's outdated. Both policies are outdated.
