This comes after the Western Cape High Court ruled on Friday that it’s an infringement to ban the use and cultivation of dagga by adults in private homes.
Parliament now has 24 months to rewrite parts of the Drug Trafficking Act that criminalises the use, possession and cultivation of dagga at home.
The successful application was brought to court by Dagga Party leader Jeremy Acton and Rastafarian Garreth Prince.
They argued that laws prohibiting dagga use are unfair, discriminatory, outdated, and applied disproportionately to black users.
