Criminal law expert Tyrone Maseko says it's difficult to predict how a commission of inquiry into state capture allegations would use the damning information contained in leaked Gupta emails.
Maseko explains that while the disclosure of classified Cabinet documents or information is generally prohibited, in some cases it is not always in contravention of the law.
This comes after leaked emails between the Gupta family and their employees apparently revealed how the family obtained business from government.
