Taxing times: Symington, Sars battle goes to court

SA Reserve Bank (Sars) Principal Specialist in the Legal Counsel Division Vlok Symington has filed an urgent application in the Pretoria High Court in a bid to prevent his 'unfair' dismissal.

Symington, who was allegedly held hostage by the Hawks in a boardroom in late 2016, applied for an interdict to stop the taxman from initiating disciplinary action against him.

He worked at Sars for 27 years and was held hostage at a time when former finance minister Pravin Gordhan was charged with fraud.

According to EWN's Barry Bateman, Symington made several revelations under the Protected Disclosures Act in which he explained that both Sars Commissioner Tom Moyane and the Hawks were aware of the information which exonerated Gordhan, but still proceeded to prosecute him.

They were aware of this document before a decision was made to prosecute Pravin Gordhan, but they purposely withheld it form the NPA. Once [NPA Head] Shaun Abrahams was made aware, he withdrew the prosecution.

After all this, Symington was surprised to find out that Sars wanted to charge him with bringing the name of the institution into disrepute for using bad language.

The revenue service then initiated a disciplinary against him.

He approached the courts to stop that disciplinary action because he believed it was retribution for the protective disclosure he made. He asked the courts for legal protection.
