Hanekom: ANC constitution can never supersede the Constitution of SA

ANC MP and former Cabinet minister Derek Hanekom says the party's constitution cannot come before the country's Constitution.

Hanekom confirmed that he has replied after being given 10 days to show cause as to why he should not be removed as chair of the ANC's disciplinary committee.

Hanekom says changes to ANC's disciplinary committee can only be made by the ANC NEC.

He explained the procedure involved in disciplinary action and says the ANC's disciplinary committee processes are fair.

Referrals to the disciplinary committee should be a measure of last resort. You should try to resolve things politically.

The constitution of the ANC is very clear on how matters are dealt with by the disciplinary committee. They must be fair, impartial and objective.

He also spoke about state capture allegations and the role of the Hawks to investigate.

Public confidence is at a very low ebb. People are not confident that the Hawks are doing their job properly, and not being instructed by certain people to drop certain charges, not investigate or do investigations on instruction.
