LISTEN: Man undergoes vasectomy but still becomes a father

Being a parent is a wonderful thing but what happens if you are told you are going to become a daddy after you've made a decision that you no longer want children?

This is exactly what happened to a Cape Talk listener, Raymond.

Raymond is over 50 years old and had a vasectomy 18 years ago. To his surprise, six years ago he was told he is going to be a daddy.

What are the legalities regarding a failed vasectomy?

According to Johann Roux, head of Medical Law at DSC attorneys, there are two types of failed vasectomies, an early failure and a late one.

In the case of Raymond it sounds like he had a late failed vasectomy.

Usually what you going to find with the late one that happens may years later, sometimes there can be what we call recanalisation. Even though those little tubes were cut off, somehow there is a little growth that occurs between them.

Doctors usually say it happens to one in a thousand.

Roux says there is unfortunately no recourse in this matter because it happened many years after the procedure was done and maybe there has been a regrowth.

He advised that Raymond should go back to check what could've went wrong with the procedure.

If it didn't result in pregnancy for many years, you can assume it was a job well done but there's been a bit of bad luck for the patient and somehow there's been a growth between the tubes.
