Sars considers legal action against Jacques Pauw and Sunday Times

Sandile Memela, SARS spokesperson says a taxpayer may not have their information revealed unless ordered so by a High Court.

After the Sunday Times published details pertaining to President Jacob Zuma's tax information the South African Revenue Service (Sars) says it may take legal action against investigative journalist Jacques Pauw.

In his book, 'The President's Keepers' Pauw alleges that Zuma received around R100 million a month from a company called Royal Security, which is linked to his friend and African National Congress (ANC) benefactor, Roy Moodley.

He also claims that Sars Commissioner Tom Moyane is helping Zuma meet his tax obligations.

Sandile Memela, Sars Spokesperson says they are engaging with their legal representatives to determine a way forward because confidential taxpayer information has been divulged which is a clear contravention of the law.

The Tax Administration Act, section 69, prohibits the revealing of information. It does not matter whether one is a cleaner or a state president, this is unacceptable and against the law.

Memela explains that this can only be done when it's within a judicial process, for example during a court case. He adds that even in that context one still needs to obtain a specific order from a High Court to do what Pauw and the Sunday Times have done.

There are two legal routes Sars is considering says Memela. He says the first is a possible criminal case for violating and undermining the law and secondly, a civil claim.
