The Clear Option's CEO, Quintin van Kerken, says the State has failed to make a convincing argument against legalising cannabis.

Lobbyist Quintin van Kerken believes that the use, cultivation and distribution of dagga will soon be legalised by the courts.

The Constitutional Court is hearing a landmark case calling for legalising marijuana.

Van Kerken, who is the CEO of The Clear Option, says the State has failed to make a convincing argument against the legalisation of cannabis.

The State had to show that dagga is more dangerous than substances like alcohol. They have failed dismally.

Myrtle Clarke and Julian Stobbs, dubbed the dagga couple, have been trying for years to have the use, cultivation and distribution of dagga legalised.

In March, High Court ruled in their favour, legalising the private use of the drug.

But the couple want a court to instruct Parliament to make new laws to reflect this.

They believe that it is irrational for the plant to be classified illegal when alcohol is freely available for purchase and use by adults.

Kerken has been involved in the legal case as an expert witness and says that the commercial sale of the substance must be regulated.
