Does SSA have a strong case against Jacques Pauw?

The State Security Agency (SSA) says the book, The President's Keepers, penned by investigative journalist Jacques Pauw, contravenes parts of the Intelligence Services Act.

The Hawks have confirmed that it is investigating the possible leak of classified information.

Constitutional Law expert and director of the Centre for Constitutional Rights, Phephelapi Dube, says the Intelligence Services Act doesn't prohibit journalists from publishing classified information by SSA as long as the information is given by a former member.

On the face of it SSA might appear to be having a case against Jacques Pauw, but on closest scrutiny, the intelligence service perhaps might not have such a strong case.

It is up to the South African Police Service to receive the complaint and investigate. They will pass the information to the Hawks who will then inform Jacques Pauw what the charges against him are so he can prepare his defence.
