Former Eskom CEO and army colonel Brian Molefe has argued that he had retired from the parastatal on the basis of early retirement but this was ruled invalid.
Molefe’s two senior counsel advocates told the North Gauteng High Court that he cannot be blamed for misunderstanding what he was entitled to in terms of early retirement and that he should be able to continue as Eskom CEO.
The Democratic Alliance and Solidarity have argued that Molefe resigned and so was not entitled to the R30 million payout for so-called “early retirement”.
