The High Court in Pretoria has ruled that former Eskom CEO Brian Molefe did indeed resign and must pay back the R11 million already paid out as a pension.
Molefe received a hefty payout when he left Eskom.
The then Public Protector Thuli Madonsela implicated him in suspicious dealings between the utility and the Guptas.
Eyewitness News reporter Gia Nicolaides has more on the judgment.
The judge has said that the decision taken by the board of Eskom to reinstate Mr Molefe and accept his early retirement proposal was set aside, in other words it is unlawful that he actually took this early retirement.— Gia Nicolaides, EWN reporter
