Former KZN Hawks boss opens criminal case against Shaun Abrahams and his No.2

Former KwaZulu-Natal Hawks head Johan Booysen has opened a criminal case against prosecutions boss Shaun Abrahams and one of his deputies Marshal Mokgatlhe.

This is in relation to a decision to withdraw fraud and perjury charges against Abrahams’ deputy Nomgcobo Jiba in 2015.

The High Court in Pretoria set aside that decision in December, but it has been taken on appeal.

Stephen Grootes spoke to Booysen on the Afternoon Drive to find out more.

If you look at the affidavits, both Mokgatlhe and Abrahams stated under oath in the litigation process that it was Mokgatlhe who withdrew the charges, but the court has now ruled it was Abrahams who withdrew the charges.

I had been consulting with the prosecutor in the Jiba matter at the time, and a week before the trial was to commence, he indicated to me that he did not have the docket and that the docket was actually with Shaun Abrahams.

I found that strange and then he informed me that Mokgatlhe had to provide a recommendation to Shaun so I found it difficult to understand. If Mokgatlhe has to provide a recommendation, how can he subsequently withdraw the charges? It doesn't tally up and that is what the court has found.

The Commission of Oaths Act says if you make a statement under oath knowing that what you are saying is false, you are committing an offence.
