De Lille can sue DA members who shared fake Auditor General Report

After a report doing the rounds that claims to be a report from the Auditor General, making some very damning findings about against the Cape Town Mayor Patricia de Lille, is fake.

It was shared by some DA members and amongst them, the deputy chief whip of the National Assembly Mark Waters who is also a Deputy Federal Chairperson of the DA.

The report was also shared by an MP in the National Council of Provinces Brownyn Engelbreght.

This report was clearly false, prompting De Lille to say that she will lay criminal charges against those DA members who shared the report.

Speaking to John Maytham, Founder of The Digital Law Company Emma Sadleir said we can even look within the DA structures to see if there is a precedent for her to lay criminal charges.

A year ago, Dianne Kohler Barnard shared the Facebook status of somebody called Paul Kirk a journalist who praised PW Botha saying things were better under apartheid and she at the time just pressed the share button. And she was found responsible for it. She was removed as a member of the DA and subsequently reinstated and given a R20 000 fine.

But there is no question from a legal point of view that if you are in, what we call the chain of publications, if you look at something and consciously decide to publish it, then you are responsible for that publication and therefore if there is anything wrong with it from a legal point of view then any consequent legal action.
