Retired judge Robert Nugent is set to give his ruling on Monday on suspended Sars Commissioner Tom Moyane's bid to halt the enquiry into governance at Sars.
Council for Moyane argued on Friday that the probe must stop pending the outcome of his separate disciplinary hearings.
He also wants Professor Micheal Katz to recuse himself from the enquiry after Dali Mpofu argued that he was conflicted because he is linked to Cyril Ramaphosa.
Speaking to Ray White on The Midday Report, EWN reporter Qaanitah Hunter says Tom Moyane has filed a motion of objection in his disciplinary enquiry.
He says that process is unfair and unlawful and he says that process cannot continue. This is interesting because he made the same assertions on Friday in the commission of enquiry that is looking into tax administration and governance in Sars.— Qaanitah Hunter, EWN Reporter
And now he has basically made the same submission to that enquiry which Robert Nugent will have to make a finding or ruling on this afternoon. He has made the same objections in his disciplinary enquiry which Advocate Razzak Bam needs to decide on.— Qaanitah Hunter, EWN Reporter
She adds that one could be tempted to say that Moyane is stalling as he has not responded to the actual charges brought to him.
The Sars commission of inquiry is happening concurrently as the 2018 tax season kicks of.
It is a shortened tax season running from the 1 July until 31 October and the target for collection this year is R 1.345 Trillion.
Ray White also spoke to CEO at South African Institute for tax professionals Keith Engel who says Sars clearly needs to do a lot of rebuilding.
Beyond that Sars went through a lot of internal friction and it was clear that two camps were at war, whichever side you were on.— Keith Engel, CEO at South African Institute for tax professionals
He adds that the friction led to a lot of people leaving the institution. And going forward, if you are going to have a commissioner, he really should be a technical person.
