High Court ruling on Jiba overturned, can return to work at NPA
The Supreme Court of Appeal has on Tuesday overturned an earlier High Court ruling disbarring the National Prosecuting Authority (NPA)'s Nomgcobo Jiba and Lawrence Mrwebi.
The Bloemfontein-based court has disagreed that the two are not fit and proper for their jobs at the NPA and that they should be reinstated to the roll of advocates.
Nicole Fritz CEO of Freedom Under Law says the court order means that Mrwebi and Jiba can go back to work at the NPA.
Freedom Under Law approached the courts and was a provisional order was handed down, pending the finalisation in the General Council of the Bar, that Jiba and Mrwebi would be prohibited from visiting the NPA offices.
The judgment today, the majority holds that Jiba's incompetence would be sufficient to disqualify her from the roll within the NPA.Nicole Fritz, Freedom Under Law CEO
We need to see if we will appeal the matter. We need to reconsider what action do we take pending the finalisation of the appeal in that matter.Nicole Fritz, Freedom Under Law CEO
