The chairman of the disciplinary inquiry into suspended Sars commissioner Tom Moyane’s conduct, Advocate Azhar Bham, has dismissed all the objections given by Moyane's legal council.
Moyane wanted provisions to be made for witnesses against him to be cross-examined. He also wanted the affidavit filed by, then Finance Minister, Pravin Gordhan discarded.
His legal representative initially wanted President Cyril Ramaphosa to halt one of the two processes underway.
Moyane's lawyer Eric Mabuza joined Joanne Joseph on the Afternoon Drive to provide details and how he will be taking the matter forward.
Advocate Bham is quite wrong on his approach. What he is essentially saying is that his hands are tied, he can't do anything about the terms of reference put forward by the President and we think that is incorrect, hence our intention to approach the court.— Eric Mabuza, lawyer representing Tom Moyane
We have exhausted internal remedies from both Bham and Commissioner Nugent. Both of them told us to approach the president, so it is up to the president how he decides on the issue. If he says he is taking their advice, we have no option but to approach court.— Eric Mabuza, lawyer representing Tom Moyane
