[LISTEN] What does the law say about maternity leave

According to South African labour law, female employees are entitled to four consecutive months of maternity leave when they are pregnant.

Attorney at Marais Muller Hendricks Attorneys, Jessica Senekal says no employer has the right to deny an employee this basic right.

An employee has a right to take the employer to the CCMA for non-compliance.

Senekal looks at other issues related to maternity like what do you do if you get dismissed because of pregnancy and when is the right time to disclose to your boss that you are pregnant.

Legally you are only required to disclose to your boss within a period of four weeks before you are intending to take your leave. But I wouldn't recommend that, I think the earlier you tell your boss the better.
