Shaun Abrahams' appointment as head of the National Prosecuting Authority (NPA) is constitutionally invalid.

That is the finding of the Constitutional Court.

Judge Mbuyiseli Madlanga was highly critical of former President Jacob Zuma, finding that he had abused his power.

Madlanga said Zuma was bent on removing former prosecutions boss Mxolisi Nxasana at all costs and effectively bought him out with a R17 million settlement.

Former President Zuma appointed Advocate Abrahams following his unlawful removal of Mr Nxasana. That removal was an abuse of power. Advocate Abrahams is a beneficiary of that abuse of power. It matters not that he was unaware of the abuse of power. The rule of law dictates that the office of the NDPP be cleansed of all the ills that have plagued it for the past few years.

The Constitutional Court gave President Cyril Ramaphosa 90 days to appoint a new National Director of Public Prosecutions.

The Money Show’s Bruce Whitfield interviewed Bonang Mohale, CEO at Business Leadership South Africa (BLSA).

BLSA on Monday welcomed the “clarification of the constitutional status of the NPA”.
