District Six victory gives govt 3 months to come up with a plan

W Cape High Court has ruled in favour of the District Six community for government to come with a plan to deliver on the claim.

Chairperson of the District Six Working Committee Shahied Ajam says the community is delighted by Judge Jody Kollapen's ruling on Monday.

Kollapen ruled that the Land Reform and Rural Development Minister and the Commission on Restitution of Land Rights should come up with a comprehensive plan to effectively deal with the District Six land claims.

Ajam says they had hoped the government would have prioritised this community in 1994 but this did not happen. The community was treated in the same way as by the apartheid regime and Kollapen has restored hope, he adds.

We showed that we are a dignified people, we are resilient and that we can win the battle. Although it's 24 years later, we have won a major part of the battle.

More than 1000 of the claimants have been seeking restitution since 1998 to go back to the land from which they were removed by the apartheid regime.

The Department of Land Reform and Rural Development and the Commission on Restitution of Land Rights have three months from Monday to give feedback as to how it will make this a reality.

This is not just about being ordered to come up with a plan but what kind of a plan are they going to come up with, thinking of the old people and the rates and taxes, thinking about the heritage...

Ajam says they are looking forward to sitting down with the local claims office and have constructive conversations about District Six.

He says the community of District Six has brilliant minds and business minded people so it will be beneficial for everyone to work together and plan ahead.
