Can you ask for money back if your car fails the safety standards?

Following the safety tests done on some entry-level cars in South Africa, can customers ask for their money back?

Based on the vehicle safety ratings of cars sold in South Africa and how they aren't as safe as their counterparts in Europe, can consumers ask for their money back?

National Consumer Commission spokesperson Trevor Hattingh says the commission hasn't received any complaints from customers but it is aware of the severity of the matter and is planning to take it up.

He says it is concerning that some of these vehicles are advertised in South Africa as having higher NCAP ratings but what is sold 'on the ground' doesn't comply with that.

That is outright unconscionable, it is unethical, you can't do that. It is even against the provisions of the Consumer Protection Act.

We are encouraging consumers to step forward. If you were sold something that was advertised as having a higher NCAP rating but what was actually sold to you does not meet those standards, bring this to our attention.

Hattingh says looking at this case at face value customers are eligible for 3Rs which is repair, replace or refund.
