Trade union Solidarity says it will head to court to overturn the suspension of the teacher who captured the image showing racial segregation at Laerskool Schweizer Reneke.

Last week, Elana Barkhuizen was suspended after a photo she took went viral, showing black and white pupils seated at separate tables in a grade R classroom.

The teacher in charge of that class has not been suspended.

Solidarity says it plans to file an urgent court application by the end of this week, reports EWN's Thando Kubheka.

Solidarity has announced that they are going to approach the courts on an urgent basis to challenge Elana Barkhuizen's suspension.

They say that Barkhuizen's sanction was wrong and unlawful. They say she was offered no opportunity to explain herself.

They say her right to fair process has been infringed.

Meanwhile, News24 editor Adriaan Basson says there has been a frustrating absence of clear facts in this story which has caused national outrage.

Even after the Solidarity press conference today, I'm none the wiser why the teacher whose class it was - not the teacher who took the picture - [was suspsened].

Adriaan Basson, editor-in-chief of News24

The picture is very problematic and someone has to explain why that happened... All we have are these hypotheses to work with.
