Dog owners may be held liable if their dog attacks a person

It is being reported that owners of dogs may well be held liable if their animals attack a person.

Legal advisor at Risk Benefit Solutions, Johannes du Plessis explains.

In this specific case, the property owner was held liable for R2.3 million of injuries and damages to the party that was injured in the road. In this matter, the court found that the property owner locked the gate and that a third party intruder caused the gate to open and the dogs then bit the aggrieved party.

The court held that although the property owner cannot be held liable on negligence, the property owner is liable because the dog, although it escaped, it did not act in accordance with that expected from a well behaved dog.
