PP subpoenas Gordhan to submit affidavit related to 'rogue unit'

The public protector has subpoenaed Public Enterprises Minister Pravin Gordhan to submit an affidavit related to the Sars investigation unit or the so-called rogue unit.

Advocate Busisiwe Mkhwebane has given Gordhan and former South African Revenue Service (Sars) commissioner Oupa Magashula seven days to reply to her questions by April 23.

Gordhan's lawyer Attorney Tebogo Malatji says they had considered this matter closed for a number of reasons.

There are three iterations of interaction with this particular matter, firstly wit was raised with the Sars authorities by the then public protector in 2014, submissions were made to her and that complaint was dispersed with on the basis that there was no wrong doing.

Secondly, as the minister was preparing for the budget speech in 2016, he received 26 questions from the Hawks. Of the charges put to him, this issue was not part of it. The case could not be prosecuted.

Malatji says the Nugent report established that no law was breached.

Justice Nugent submitted a report in September 2018, and came to the conclusion that there is no basis in fact and in law for the suggestion that the unit - actually a high risk investigation unit focused at the illicit economy, nothing wrong with that capacity.

He says the minister has yet to be advised on the proper course of action.
