Associate professor in public law Cathy Powell says the challenges against Public Protector present cases of possible misconduct.

Public Protector Busisiwe Mkhwebane faces yet another court battle.

The Financial Sector Conduct Authority has filed papers in the Pretoria High Court requesting it to review and set aside her report, which found its former board executive Dube Tshidi guilty of impropriety and maladministration.

The report was issued n March and found that Tshidi misled Parliament and used his position to protect a compromised curator, Antony Louis Mostert.

Nickolaus Bauer speaks to University of Cape Town associate professor in public law Cathy Powell about what this means for Mkhwebane.

Her calling on God directly like that is a sign that she has run out of arguments in the constitution itself which is where you would expect her to work.

The constitution allows for her removal, and if she does get removed, that is how it is going to happen. It will happen under section 194.

Unfortunately, these court cases are presenting cases of certainly incapacity possible misconduct.
