Another small business owner is accusing Woolworths of stealing his designs.

Dave Hutchison is the founder of Sexy Socks.

He claims that Woolies ripped off his designs.

We're not a bunch of plagiarists... Sometimes we get it wrong… We produce 100 000s of items each year… We’d be a crazy business… to go out and copy...

Ian Moir, CEO - Woolworths (on 21 February 2019)

Woolworths denies the allegation.

It says that bicycles are trendy and used in designs all around the world.

Woolworth claims to have used the bicycle designs since 2015 on boxers, t-shirts, socks and shorts.

The Money Show’s Bruce Whitfield interviewed Sexy Socks founder Dave Hutchison and Andrew Papadopoulos, a trademark attorney at KISCH IP.

We’ve given roughly 65 000 pairs of socks [to poor school kids] …

Dave Hutchison, founder - Sexy Socks

A design that is similar to ours. It’s been changed subtly… I don’t believe they have copied directly… but it looks frighteningly similar to our range…

Dave Hutchison, founder - Sexy Socks

Once you’ve got consumers that are confused; that’s one of the things you look at…

Andrew Papadopoulos, trademark attorney - KISCH IP

They [Woolies] are under a microscope. I wouldn’t want to be in their position.

Andrew Papadopoulos, trademark attorney - KISCH IP

You toil day and night… As soon as it gets some traction… then you walk into a big chain store and you get hit with that sinking feeling of despair as you see something that looks strikingly similar to your product… at a price a third of what you’re able to charge for it.

Dave Hutchison, founder - Sexy Socks

It’s about big business realising the role it plays in society…. They have tremendous power… significant consequences for small businesses…

Dave Hutchison, founder - Sexy Socks
