Mkhwebane to oppose Gordhan’s court bid to set aside her report on rogue unit

Mail & Guardian political editor Natasha Marrian weighs in on public enterprises minister and Public Protector fight.

The fight between Public Enterprises Minister Pravin Gordhan and Public Protector Busisiwe Mkhwebane will now be decided in court.

However, Mkhwebane will oppose Gordhan’s court bid to set aside her recent report on the so-called “rogue unit” at the South African Revenue Service (Sars), she said on Thursday.

Mkhwebane’s report made a number of findings against Gordhan and former Sars deputy commissioner Ivan Pillay.

Her report also found that the investigating unit at Sars known as the “Sars rogue unit” was unlawfully formed and had conducted unauthorised operations.

To discuss this ongoing battle, Bongani Bingwa chats to Mail & Guardian political editor Natasha Marrian.

In his affidavit, Gordhan does draw a distinction between what they initially envisioned for them to do what the NIA did, but that didn't happen because the NIA lost the appetite for it.

She says Mkhwebane disagrees with what Gordhan says, arguing that he was only allowed to establish a unit with the National Intelligence Agency.

The Public Protector says in her report she has evidence of equipment lists used for this intelligence work.
