[LISTEN] ConCourt judgment makes Mkhwebane's position a lot weaker - Friedman

Professor Steven Friedman gives his take on Monday's ruling and what this means politically.

Professor Steven Friedman says a Constitutional Court judgment upholding the High Court's order that Public Protector Busisiwe Mkhwebane personally pay 15% of the South African Reserve Bank’s legal fees makes her position a lot weaker.

On Monday the ConCourt confirmed the lower court’s finding that Mkhwebane acted in bad faith.

In the scathing majority judgment, Justice Sisi Khampepe said that Mkhwebane’s conduct warranted the personal costs order against her.

Friedman says if there is a series of high-profile judgments in which the courts suggest she is not the right person for the job then it becomes easier to remove her but he does not see that happening anytime soon.

We still need to watch what the courts say in the Gordhan review and the Ramaphosa review.

Any significant movement on this [her potential removal] is going to have to wait until after these two judgments have been handed down and remember that this might take a while.
