'Hout Bay community determined to prevent release of repeat offenders on bail'

Residents of Hout Bay have engaged the services of top criminal attorney William Booth in case of murdered Ukrainian tourist.

In the wake of the latest reports of tourists being targeted by criminals, Tourism Minister Mmamoloko Kubayi-Ngubane has made a point of re-assuring visitors that South Africa is a safe travel destination and that their safety is a top priority for the government.

In another attack in Table Mountain National Park, a Ukrainian tourist was stabbed to death last weekend near East Fort on scenic drawcard, Chapman's Peak Drive. Three arrests have been made.

Hout Bay residents have now engaged the services of top criminal attorney William Booth in their fight against repeat offenders being allowed out on bail.

In conversation with CapeTalk's Africa Melane, Booth says like most communities in the Western Cape and indeed the rest of the country, they are simply sick of these kinds of attacks.

I just believe they want the matter to be conducted properly and they want to ensure that at the end of it, bail is in fact refused for these people who've been arrested.

Booth says while the law is very clear on the criteria for bail, both the police and the prosecuting authorities are under tremendous pressure because of the amount of cases they have to handle.

On a daily basis in our courts there are so many cases that often things slip through, because there are just too many cases and the prosecutors may not be able to gather all the background information that I would be able to do in engaging with the prosecuting authorities.

My role is to to assist the community - they don't want bail to be granted, and to make sure that legally speaking, all the evidence is gathered, presented and everything is discussed with the prosecutors who are going to be opposing bail in this matter.

He notes that the law makes it very difficult for an accused person to be released on bail, particularly if it is a Schedule 6 offence, but much depends on the evidence presented linking the accused to the crime.

The court has to look at whether the person has prior convictions, have they got fixed addresses, are they working and obviously the interests of society, the community.

I think they've taken this particular case and want to prove a point and show potential perpetrators what are the risks if you go out and attack people who are walking and rob them, as a deterrent.
