NPA charges debacle - a 'cause for concern'

Director of Center for Constitutional Rights, Advocate Johan Kruger spoke to John Robbie about the reports that the National Prosecuting Authority (NPA) is preparing criminal charges against the former SA Revenue Service (SARS) boss Ivan Pillay, the former hawks head Anwa Dramat and SA’s top prosecutor Gerrie Nel.

The National Director of Public Prosecutions Shaun Abrahams will charge the three in connection with two different cases: the SARS spy unit matter and that of the illegal renditions of five Zimbabwean. Abrahams has also decided to drop charges against his deputy Nomgcobo Jiba and the Specialized Commercial Crimes unit head Lawrence Mrwebi.

Says Advocate Kruger, if it is indeed true that the NPA is pressing charges or dropping charges, the process should be factual.

Withdrawing charges based on fact, must be a rational decision, if not, the decision can be taken on review. That is where the concern lies at the moment, if the report is true that charges were dropped, we're not sure based on what kind of rationality those decisions were taken.
