Judge Krieglier: Jiba issue 'a diversion'

Advocate Nomgcobo Jiba said in her press conference this afternoon that she has been vindicated by the NPA National Director, Shaun Abrahams' decision to withdraw criminal charges against her, as she insists she is an upstanding official 'dedicated to serving the people of South Africa'.

However Judge Johann Kriegler told Stephen Grootes on the Midday Report that that decision cannot be legal. Judge Kriegler says the statement read by Abrahams yesterday suggests a member of the NPA who commits a crime gets exonerated.

That is not the law. It cannot be the law. Crucial provision only made if that person acted in good faith, but what she is said to be guilty of is misleading the court and dishonesty.

It is a recognised technique to try to divert attention to a side issue. The issue was simple, was Adv. Jiba guilty of gross misconduct or not? We are being diverted.
